1. Acceptance of Terms

By downloading, installing, or using the Frequency app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use Frequency. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

To use Frequency you must create an account with a valid email address and a username. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

Frequency allows you to record and share audio content ("Casts"), text replies, and hashtags ("User Content"). You retain ownership of the content you create. By posting User Content on Frequency, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and distribute your content solely for the purpose of operating and improving the App.

6. Recording Consent

Frequency is a self-recording platform. By using the recording feature, you confirm that you consent to being recorded. If your recording includes the voice of another person, you are solely responsible for obtaining their consent in accordance with the laws of your jurisdiction. We are not responsible for any recording consent violations by users.

7. Microphone Access

Frequency requires access to your device's microphone to record audio. We only access your microphone when you actively initiate a recording within the App. We do not record, store, or transmit any audio without your explicit action.

8. Content Moderation

We reserve the right, but are not obligated, to review, remove, or restrict access to any User Content that we determine in our sole discretion violates these Terms or is otherwise objectionable. We are not responsible for User Content posted by other users.

9. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease.

10. Intellectual Property

The Frequency app, including its name, logo, design, and all original content created by us, is owned by Frequency and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without our express written permission.

Your use of Frequency is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

12. Disclaimer of Warranties

Frequency is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your sole risk.

13. Limitation of Liability

To the fullest extent permitted by law, Frequency and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

14. Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes by updating the effective date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
